Scope of the Terms

These General Terms and Conditions of Business constitutes an agreement between you and Selfy Lifestyle (hereinafter referred to as "us", or "we", or "Selfy", or "Owner") with regard to the Selfy application for Mobile Phones (herein referred to as "Software Product" or "Software"). The subject matter of this contract is the paid or unpaid use of services, products, content and functionality.

By installing the Software, you agree to be bound by the terms of this license agreement. Your use of the Software (as specified below) is subject to the terms and conditions set forth in this General Terms and Conditions of Business. If you do not accept the Terms, do not install or use the Software.

License, Restriction of Use and Copyright

Selfy App is intended exclusively for consumers. The legal definition of a consumer is every natural person that enters into a legal transaction for reasons that cannot be chiefly attributed to either their commercial or their self-employed occupation. Use of Selfy for commercial purposes of any kind is expressly prohibited, unless we have authorized you to distribute the Software.

The Software is licensed, not sold. We grant you a non-exclusive, non-transferable, non-sublicensable, limited right and license to use one copy of the Software for your personal, non-commercial use on a single device. The rights granted herein are subject to your compliance with this Terms. You shall not make or distribute copies of the Software, transfer the Software from one device to another, decompile, reverse engineer, disassemble, translate the Software, or use the Software for any commercial purposes. You shall not modify, alter, change or otherwise make any modification to the Software or create derivative works based upon the Software. You shall not rent, lease, resell, sub-license, assign, distribute or otherwise transfer the Software or this license. Any attempt to do so shall be void and of no effect.

You acknowledge that no title to the intellectual property in the Software is transferred to you. You further acknowledge that title and full ownership rights to the Software will remain the exclusive property of Selfy, and you will not acquire any rights to the Software. You shall not remove or obscure the Owner's copyright, trademark or other proprietary notices from any of the materials contained in this package or downloaded together with the Software.

User Account and Registration

In order to use the Selfy App, you must first register and open a user account to use the Software. You can open a user account via our mobile app. During registration, we will ask you to accept these General Terms and Conditions of Business and the relevant privacy policy. After you register, for security reasons we will first send you an email in which we ask you to verify the registration by clicking on the personal link. After you have clicked on this link you will be redirected to a website where we will finally confirm your registration. Only then will the registration process be complete.

You also have the option of signing in with your Facebook, Google, or Apple accounts. In this case, the sign-in process is completed when you have entered the account information for your corresponding account and clicked "Continue" button.

Services and Prices

With Selfy we provide the free-of-charge access to the Software. When you use it free-of-charge you have access to the basic functions and information of the respective Selfy App.

Updates, Modifications, and Disclaimer of Warranty

We may release updates or modifications to the Software from time to time, which may add, modify, or remove features or functionality. Your use of the Software may be subject to these updates or modifications, and you agree to accept and install them as required by the Owner.

The Software is provided "as is", without warranty of any kind. We disclaim and make no express or implied warranties and specifically disclaim the warranties of merchantability, fitness for a particular purpose and non-infringement of third-party rights. The entire risk as to the quality and performance of the Software is with you. We do not warrant that the functions contained in the Software will meet your requirements or that the operation of the Software will be error-free.

Medical disclaimer

Use of the Selfy is at your own risk. In any case a condition for the use of the Selfy Services is that you must be in a good general state of health. If you have knowledge of any pre-existing medical conditions we advise you to seek medical advice from a doctor urgently before you start the Selfy Services (such as daily trainings or plank challenge). This applies in particular if you have knowledge of one or more of the following medical preconditions / procedures / complaints:

• cardiovascular disease,
• lung or respiratory disease (including asthma),
• spinal and / or joint problems,
• neuromuscular disease,
• surgical procedures,
• pregnancy and breast-feeding,
• any other health issues

The services and information offered by Selfy do not constitute medical advice or a doctor's advice. Nor are they a substitute for a medical examination or treatment by a doctor. Fitness, sleep and / or nutritional advice that you may find inside the Software is subject to constantly evolving knowledge in relation to health science, nutritional science and sports science. Although we base our trainings and nutritional tips on current studies and knowledge, we do not guarantee that these reflect the most up to date research findings or knowledge.

Limitation of Liability

In no event will Selfy be liable for special, incidental or consequential damages resulting from possession, access, use or malfunction of the Software, including but not limited to damages to property, loss of goodwill, computer or mobile device malfunction and, to the extent permitted by law, damages for personal injuries, property damage, lost profits or punitive damages from any causes of action arising out of or related to this General Terms and Conditions of Business or the Software, whether arising in tort (including negligence), contract, strict liability or otherwise and whether or not we have been advised of the possibility of such damages.

Because some states / countries do not allow certain limitations of liability, this limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction. This limitation of liability shall not be applied solely to the extent that any specific provision of this limitation of liability is prohibited by any federal, state, or municipal law, which cannot be pre-empted. This General Terms and Conditions of Business gives you specific legal rights, and you may have other rights that vary from jurisdiction to jurisdiction. In no event shall Selfy's liability for all damages (except as required by applicable law) exceed the actual price paid by you for use of the Software.
